Where you register

BDO

Does Polish tyres EPR apply to you

Tyres EPR in Poland catches you at the point of first placing tyres on the market. The Act of 11 May 2001 on product fees is the legal basis, the same act that covers waste oils and fishing gear under EPR in Poland, and every duty runs through the BDO.

You are a tyre producer here if:

  • You manufacture tyres and place them on the Polish market
  • You import tyres into Poland for the first time
  • You sell tyres under your own brand in Poland
  • You place vehicles with tyres on the Polish market (vehicle tyres count)

There is no verified threshold or de minimis for tyres in Poland. The 2001 Act does not establish an authorised representative mechanism for this stream. No AR route has been confirmed on an official source.

What you pay and to whom in Poland

The fee model narrates simply: your money funds tyre recovery. A product fee (opłata produktowa) applies on the shortfall against statutory recovery and recycling targets for tyres.

Hit your targets and you owe nothing beyond scheme costs. Fall short and the fee covers the gap between what you achieved and what the law requires.

A recovery organisation (organizacja odzysku) can handle the obligation entirely, collecting used tyres and channelling them into retreading, material recycling, or energy recovery.

The product fee on tyres is not a fixed licence. It only applies when your recovery falls short. If you meet the statutory targets, whether directly or through a recovery organisation, no product fee is due.

The dates ahead for tyres in Poland

Tyres have no pending EU directive or regulation that would change the national model. The Waste Framework Directive sets general requirements but leaves tyre EPR to member states.

The voivodeship environmental inspector (WIOŚ) enforces compliance, and Poland places no verification duty on online marketplaces.

The 2001 Act remains the governing law, and the stream is the most stable and procedurally predictable of Poland's eight active duties.
