The cost falls on the producer's obligation to finance and guarantee sufficient collection through CATs, not on a scheme fee or register contribution. EU targets apply: 95 percent recovery and 85 percent reuse and recycling by weight, in force since 2015 under the ELV Directive 2000/53/EC.
Importers not established in Spain generally act through an authorised representative. RD 265/2021 places the duty on the manufacturer or professional importer that first places the vehicle on the market.
How Spain polices end-of-life vehicles EPR
Enforcement runs through the Ley 7/2022 sanctions regime (Título IX, Arts 108-109), grading infractions as leve, grave or muy grave.
The new EU ELV Regulation cleared the European Parliament on 18 June 2026 but is not yet in force. It will widen the scope to include new vehicle categories and set recycled-plastic content requirements, but until it enters force, RD 265/2021 governs.
