Where WEEE producers register in Spain
WEEE EPR in Spain sits at the Ministry of Industry, not MITECO. Real Decreto 110/2015 transposes the EU WEEE Directive 2012/19/EU and requires every producer who places electrical or electronic equipment (EEE) on the Spanish market to register in RII-AEE before the first unit ships.
The broader EPR in Spain system splits across two ministries. WEEE and batteries go through the Ministry of Industry; packaging, tyres and SUP go through MITECO. Getting the ministry wrong delays your registration.
A producer not established in Spain must work through a representante autorizado established in Spain (RD 110/2015 Art 8.1). Producers of household EEE must show that future waste-management cost is covered, whether through scheme participation, insurance or a blocked account.
After registration comes the reporting
Spain reports WEEE quarterly, not annually, and that is the cadence that catches sellers used to once-a-year filing. You report quantities of EEE placed on the market each quarter through the same RII-AEE login.
Register before placing EEE on the market. The scheme contribution, set by EEE category and weight, is what you actually pay. Spain publishes no official per-unit rate.
How Spain polices WEEE EPR
Enforcement runs through the Ley 7/2022 sanctions regime (Título IX, Arts 108-109), grading infractions as leve, grave or muy grave.
Marketplaces such as Amazon require a valid registration number as their own policy, though no Spain-specific statutory marketplace ID-check duty for WEEE has been grounded.
The European Commission opened a WEEE Directive evaluation in July 2025, so revision is direction of travel but not law yet. The PPWR applies from 12 August 2026 for any EEE packaging.
Frequently asked questions about Spanish WEEE EPR
Key questions for electronics sellers in Spain.
What does WEEE EPR mean in Spain?
It means the producer who first places EEE on the Spanish market finances its collection and recycling. You register in RII-AEE at the Ministry of Industry, join a SCRAP and report quarterly.
Do foreign or online sellers need an authorised representative in Spain?
Yes. A producer not established in Spain, including distance sellers, must register through a representante autorizado. RD 110/2015 Art 8.1 covers distance sellers explicitly.
When are WEEE reports due in Spain?
Quarterly reporting of quantities placed on the market. Register before placing the first unit. This is faster than most EU countries, which report annually.
What changes next for WEEE EPR in Spain?
The Commission opened a WEEE Directive evaluation in July 2025, so revision is being discussed but no new law is in force. The PPWR applies from 12 August 2026 for any EEE packaging.
