How registration works in Malta
Single-use plastics EPR in Malta is architecturally simpler than most EU implementations. Since 5 January 2023, SUP producers register under the packaging regulations (S.L. 549.43) with a unique SUP number.
You then join an authorised packaging PRO. There is no standalone SUP registration or separate scheme.
You are a SUP producer in Malta if you check any of these:
- You manufacture SUP items (food containers, cups, wet wipes, balloons) placed on the Maltese market
- You import SUP items into Malta
- You produce tobacco products with filters (added via LN 126/2025, 8 July 2025)
Selling SUP into Malta from abroad
Since SUP registration runs under the packaging regulations, the packaging AR provision (S.L. 549.43 r.21(8)) likely applies to SUP distance sellers. Foreign sellers should follow the packaging AR rules and register through a representative.
SUP beverage containers may also be BCRS deposit containers. The deposit scheme (operated by BCRS Malta, EUR 0.10 per container) covers the packaging EPR for those specific items, so there is no double charge.
Before you can sell in Malta
The registration runs through the packaging system, and the renewal follows the standard 31 March annual cycle.
Tobacco-filter EPR was added through LN 126/2025 (published 8 July 2025). The collective PRO for tobacco filters has not been confirmed as authorised by ERA yet (as of mid-2026), creating practical uncertainty for tobacco-filter producers specifically.
The dates ahead for single-use plastics in Malta
The EU SUP Directive (Dir (EU) 2019/904) continues to roll out targets. By 2029, Malta must separately collect 90% of plastic beverage bottles. By 2030, plastic bottles must contain at least 30% recycled content.
The EPR funding covers litter clean-up, collection and treatment, awareness campaigns, and data collection. Malta's island geography makes litter costs particularly tangible for coastal municipalities.
