Selling single-use plastics into Spain
Single-use plastics EPR in Spain is only partly in force. Ley 7/2022 (Título V) transposes the EU SUP bans, marking rules and design requirements, but full producer-responsibility EPR is live for only some items.
Tobacco filters have their own decree (RD 1093/2024 with an RPP section), SUP items that are also packaging report through the packaging regime (RD 1055/2022), and the royal decrees for wet wipes and balloons are still pending as of July 2026.
The broader EPR in Spain system runs six fully active streams. Single-use plastics sits alongside them as a partial seventh.
Does Spanish single-use plastics EPR apply to you
The duty falls on the business that first places the SUP product on the Spanish market:
- Tobacco-filter producers (full EPR under RD 1093/2024)
- Producers of SUP items that are also packaging (report through the packaging SCRAP)
- Producers of wet wipes and balloons (EPR mandated but royal decrees not yet adopted)
You register in the relevant RPP section at MITECO: tobacco filters under RD 1093/2024, packaging-SUP under RD 1055/2022. A foreign producer needs a representante autorizado in Spain.
Packaging-SUP items follow the 1 January to 31 March declaration.
For tobacco filters, EPR covers litter clean-up, collection and awareness costs. No official per-unit amount is public. Enforcement runs through Ley 7/2022 (Arts 108-109), grading infractions as leve, grave or muy grave.
The dates ahead for single-use plastics in Spain
The missing decrees for wet wipes and balloons will expand the scope once adopted. RD 1055/2022 also holds a conditional deposit-return system (SDDR) for single-use plastic beverage bottles, triggered if separate-collection targets are not met.
The PPWR applies from 12 August 2026 for any SUP items that are packaging.
