Does Polish SUP EPR apply to you
Poland implemented single-use plastics EPR in Poland through the Act of 14 April 2023, amending the 2001 Product Fee Act rather than creating a standalone law. That means SUP obligations sit inside the same legal home as tyres, lubricant oils, and fishing gear under EPR in Poland.
The implementation arrived in two waves. Bans on specific items and mandatory labelling took effect on 24 May 2023. The financial layer followed from 1 January 2024: a consumer fee on SUP cups and containers, plus producer fees financing litter clean-up and awareness campaigns.
The roles covered are:
- Producers who first place SUP products on the Polish market
- Importers bringing SUP items into Poland for the first time
- Own-brand sellers placing SUP products under their label
- Fillers and brand owners whose products end up in SUP packaging
Before you can sell SUP in Poland
Registration runs through the BDO before placing SUP products on the Polish market. The voivodeship marshal assigns a BDO registration number.
The double-obligation trap matters here. Many SUP items (cups, food containers) are also packaging, so one product can owe both a SUP litter fee and a packaging product fee. The two obligations are separate, and both run through the BDO.
No AR route has been verified for SUP specifically. The 2023 SUP implementation act does not establish a standalone authorised representative mechanism for this stream.
Your reporting duties in Poland
The annual report (sprawozdanie) goes through your BDO account by 15 March for the previous calendar year. It covers the SUP products you placed on the market and your compliance with the financial duties.
The fee structure has multiple layers. The consumer fee on SUP cups and containers is collected by the seller and paid to the voivodeship marshal, with 95 percent going to NFOŚiGW. Producer fees finance litter clean-up and awareness campaigns separately.
The deposit-return system (system kaucyjny) on beverage containers, live since 1 October 2025, overlaps with some SUP items. The SUP consumer fee on cups and containers is a separate obligation from the deposit, and both can apply to the same product.
Tobacco filters got their own earlier start date: 5 January 2023, making them the first SUP category with an active EPR duty in Poland. Other SUP EPR duties followed by 31 December 2024.
