The deposit system does not clear the packaging duty

In-scope PET bottles and cans sit in the deposit system under Act 302/2019, but all other packaging stays in packaging EPR. A drinks producer is in both regimes at once, so the deposit is not an exit from producer responsibility.

Selling from abroad and enforcement

A producer with no Slovak seat, including a distance seller, must appoint a Slovak-seated authorised representative, the splnomocneny zastupca, to carry the packaging duty under section 27 of the Waste Act. Enforcement runs through the Slovak Environmental Inspectorate under section 117, as an administrative penalty. Slovakia runs no marketplace-identifier gate of the German kind, so the duty sits squarely on the producer or its representative rather than on a platform check.

The three cost layers in Slovakia

The money picture has three layers. The register itself carries no state fee. The paying layer is the recycling contribution your scheme sets by material and weight. The third layer is eco-modulation, where recyclability drives the per-material rate, so harder-to-recycle formats cost more. Slovakia sets no statutory tariff, so any rate you see is a scheme's own figure, not an official one.

Why a Slovak drinks producer pays twice

Selling packaging into Slovakia

What pulls you in is placing packaging on the Slovak market. Picture your own shipment: goods sent to Slovak buyers wrapped in cardboard, in filled bottles, or handed over in service packaging at the till. Whoever first places that packaging on the market carries the duty.

The obligation sits in sections 52 to 59 of the Waste Act 79/2015 and follows the producer or importer regardless of size. There is no small-producer threshold, so every packaging producer registers whatever the volume.

Reporting packaging volumes in Slovakia

You report the packaging placed on the market by material through your scheme, under the evidence-and-reporting duty in Decree 366/2015, on the scheme's schedule with an onward annual return.

The RVVV is filed through the ISOH portal kept by the environment ministry. A producer with no Slovak seat acts through an authorised representative under section 27.

Slovakia's packaging pipeline

The near-term change is European and directly binding. The Packaging and Packaging Waste Regulation, Regulation (EU) 2025/40, applies across Slovakia from 12 August 2026 with no separate national adoption needed.

It reaches further than the fee. PPWR reshapes the packaging itself through recyclability and reuse rules and hardens material-based eco-modulation, so the contribution logic that already runs here gets stricter.

The revised Waste Framework Directive is due to be transposed by 17 June 2027. Both connect to the wider EPR in Slovakia framework.
